Probate is the court-supervised process of authenticating a last will and testament if the deceased made one. It includes locating and determining the value of the decedent's assets, paying their final bills and taxes, then distributing the remainder of the estate to their rightful heirs or beneficiaries.

Our office offers DocuBank as part of a client service package to ensure that your living will, health care power of attorney and other important medical information will be available at the hospital when needed. The US Supreme Court has ruled that an inherited IRA is not protected from creditors (Clark v Rameker).  If you want to protect your beneficiaries against loss to the bad guys, you will want to consider naming a special retirement trust as the beneficiary of your IRA.
